What is DirectMortgageLoans.com?
DirectMortgageLoans.com is a Limited Liability Company organized under the laws of the State of Maryland("Direct Mortgage Loans"). Direct Mortgage Loans is an electronic loan request aggregator. Direct Mortgage Loans is not a lender, auto financier or credit card issuer, nor are we insurance brokers. Direct Mortgage Loans does not make loans or credit decisions in connection with loans, nor does Direct Mortgage Loans issue commitments or lock-in agreements. Direct Mortgage Loans is not an agent of you, the consumer, or any participating bank, lender or loan broker (all of these hereinafter referred to as "Lenders"). Direct Mortgage Loans' services are administrative and consultative only. Consumers, Brokers and Lenders should rely on their own judgment in deciding which available loan product best suits their needs and financial means. Consumers are not charged a fee to use Direct Mortgage Loans services and are under no obligation to use Direct Mortgage Loans to commence the financing process and Direct Mortgage Loans does not guarantee that completing a loan quote request will result in your receiving a loan from a Lender. Direct Mortgage Loans receives its compensation from the Lenders for the goods, facilities and services actually provided by Direct Mortgage Loans.

The loan quote request a consumer submits is NOT an application for credit. Rather, it is a request for a loan quotation. Direct Mortgage Loans does not request, obtain or review consumer credit history reports as part of our services.

Not a lender. Direct Mortgage Loans is not a lender and does not make loans. Loans are made only by participating lenders who are solely responsible for all aspects of their products and services and who are duly licensed by the appropriate regulatory body in the jurisdiction in which they are originating mortgage loans. Direct Mortgage Loans does not make any guarantees or representations about the products or services offered by its network of participating lenders. Direct Mortgage Loans does not endorse, warrant or guarantee service or products of any lender or broker and does not guarantee and makes no representation regarding any rates, points and loan programs offered or advertised by lenders and brokers. All information is subject to change without notice. Direct Mortgage Loans shall not be responsible or liable for any products, services, information or other materials displayed, purchased, or obtained by consumers from our lender partners, including, without limitation, any agent referrals, loan recommendations, application, approval, pre-qualification, loan or interest rate analysis. Nothing on this web site contains an offer, promise or otherwise, either to make a specific loan or that any participating lender or broker will make any loan for any purpose or on any specific terms.

No obligation. You are under no obligation to use Direct Mortgage Loans to apply for your loan, even if you use it to research loan products from participating lenders.

No guarantee. When using Direct Mortgage Loans, there is no guarantee that you will be able to close a loan from any of the network of participating lenders. Each lender has its own standards for loan approval. Rates quoted are not locked until a separate agreement is made with the lender. Other lender costs are estimates; the actual cost may vary.

No direct fees. Direct Mortgage Loans does not charge direct fees to you, the borrower. The payment will be based on the services Direct Mortgage Loans provides to your lender.

State/Federal Disclosures
Your lender will make certain disclosures to you when you complete your loan application with them. These disclosures, which are required by the Truth in Lending Act (TILA),the Real Estate Settlement Procedures Act (RESPA), and certain other federal and state laws, include details of your cost of credit; good faith estimates of your settlement costs; HUD mandated booklets "Guide to Settlement Costs" and/or "When your Home is on the Line"; notices concerning the possibility that your mortgage loan servicing may be transferred; and your right to a copy of any appraisal, if any, performed on your home. The Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), because all or part of the applicant's income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. ERRORS AND DELAYS
Direct Mortgage Loans is not responsible for any errors or delays in responding to a qualification form or referral form caused by an incorrect e-mail address provided by you or other technical problems beyond our reasonable control.

DISPUTE RESOLUTION
Any claim or controversy arising out of or relating to the use of this Web site, to the goods or services provided by Direct Mortgage Loans, or to any acts or omissions for which you may contend Direct Mortgage Loans is liable, including but not limited to any claim or controversy as to arbitrability ("Dispute"), shall be finally, and exclusively, settled by arbitration. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures, or Streamlined Arbitration Rules and Procedures as applicable pursuant to the claimed damages. Judgment on the Award may be entered in any court having jurisdiction. Venue for the arbitration shall be in Baltimore, Maryland, except for Maine consumers for whom the location shall be a place reasonably convenient to the consumer. The arbitrator shall be selected pursuant to the JAMS rules. Should no JAMS rule regarding the selection of an arbitrator be in effect, the consumer shall select an arbitrator from a panel of arbitrators acceptable to Direct Mortgage Loans. The party bringing the action will pay the filing fee, plus the costs associated with the first day of arbitration, with the remaining costs of arbitration paid by the non-prevailing party, provided, however, that in Maine any cost to the consumer shall be limited to the cost of filing a court case. To begin the arbitration process, a party must make a written demand therefor.

Any judgment upon the award rendered by the arbitrators may be entered in any court of competent jurisdiction in Baltimore, Maryland. The arbitrators shall not have the power to award damages in connection with any Dispute in excess of actual compensatory damages and shall not multiply actual damages or award consequential, punitive or exemplary damages, and each party irrevocably waives any claim thereto, except in Maine where state law will control all rights and remedies in the arbitration. The agreement to arbitrate shall not be construed as an agreement to the joinder or consolidation of an arbitration under this agreement with an arbitration of disputes or claims of any non-party, regardless of the nature of the issues or disputes involved.

THIS AGREEMENT PROVIDES THAT ALL DISPUTES BETWEEN YOU AND DIRECT MORTGAGE LOANS WILL BE RESOLVED BY BINDING ARBITRATION. YOU THUS GIVE UP YOUR RIGHT TO GO TO COURT TO ASSERT OR DEFEND YOUR RIGHTS. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS. YOUR RIGHTS WILL BE DETERMINED BY NEUTRAL ARBITRATORS AND NOT A JUDGE OR JURY. You are entitled to a fair hearing, but the arbitration procedures are simpler and more limited than rules applicable in court. Arbitrator decisions are enforceable as any court order and are subject to very limited review by a court. By using Direct Mortgage Loans's goods and services you consent to these restrictions.

Should a Dispute arise and should the arbitration provisions herein become inapplicable or unenforceable, or in any instance of any lawsuit between you and Direct Mortgage Loans, the parties agree that jurisdiction over and venue of any suit shall be exclusively in the state and federal courts sitting in Baltimore, Maryland. If either party employs attorneys to enforce any right in connection with any Dispute or lawsuit the prevailing party shall be entitled to recover reasonable attorneys' fees.

OTHER TERMS
This Agreement constitutes the entire agreement between you and Direct Mortgage Loans and it supersedes all prior or contemporaneous communications, promises and proposals, whether oral, written or electronic, between you and Direct Mortgage Loans with respect to this Web site and information, software, products and services associated with it. This Agreement shall be subject to and construed in accordance with the laws of the State of Maryland, excluding its conflict of laws principles. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision, and the remainder of the Agreement shall continue in effect. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. All rights not expressly granted herein are reserved.
